TV STAR KELLY RUTHERFORD’S CUSTODY BATTLE TURNS INTO REAL LIFE HOLLYWOOD DRAMA

Kelly Rutherford, actress of the former hit TV show “Gossip Girls,” is now playing her biggest role yet, a mom fighting for her children.

Kelly Rutherford married German business man Daniel Giersch back in 2006. The couple had two children, Helena and Hermes, before they filed for divorce just two years later, which was finally granted in 2010. The exes have been publicly battling for custody of their kids ever since. Rutherford and Giersch originally had an amicable joint custody arrangement until Giersch’s American visa was revoked in 2012 and he was forced to leave the country and moved to Monaco. Even though both children are American citizens, a California court ordered the children to live overseas with the father since Giersch is no longer allowed to enter the U.S. and Rutherford is able to travel there. The move was supposed to be temporary but Giersch never reapplied for a U.S. visa and the children have been in Monaco ever since.

Meanwhile, the mom of two has been fighting to bring her American born children back to the U.S. Up until this summer Rutherford had been traveling overseas to see her children, but enough is enough! In May, a California judge ruled that Rutherford was to be granted temporary sole custody of her children and the children were finally brought back to the U.S. Since then, California family court is claiming they no longer have jurisdiction over the matter because the actress now resides in New York. However, New York family court is also claiming they have no jurisdiction because the children live overseas. Therefore, a Monaco court took over jurisdiction, as Giersch is claiming the kids are “habitual residents” there. The Monaco court allowed the children to remain in the U.S. for the summer but the kids were to be brought back to France on August 7, 2015. Now, Rutherford is refusing to send children back stating, “No state in this country requires me to send the children away from the United States to live in a foreign country.”
